Terms of Service

These Terms are an agreement between you and BTech LLC, a New Mexico limited liability company, for BiaVis. By accepting, you confirm that you are at least 18, can enter this agreement, and agree to these Terms and the incorporated Community Guidelines, Privacy Policy, and Safety notice. If you do not agree, do not use BiaVis.

Fitness service, not medical advice

BiaVis is a fitness and entertainment product, not a medical device, emergency service, coach, navigation service, or substitute for professional medical advice. Metrics and verification can be inaccurate. You decide whether an exercise, route, event, opponent, device setup, and environmental condition are appropriate. Stop immediately if you feel pain, dizziness, faintness, chest pressure, unusual shortness of breath, confusion, or unsafe conditions, and seek appropriate help.

Your account

You are responsible for your device and account activity. Sign in with Apple may be used to recover a claimed account. Do not sell, share, automate, or misuse an account. Provide accurate declarations requested for competition, including electric-assist use. BTech may restrict an account to protect users, investigate abuse, enforce these Terms, or comply with law.

License and acceptable use

BTech grants you a personal, limited, revocable, nonexclusive, nontransferable license to use BiaVis on Apple-branded products you own or control as permitted by Apple’s Usage Rules, including use through Family Sharing where Apple permits it. You may not copy, sell, reverse engineer except where law expressly permits, disrupt, scrape, automate, introduce malicious code, evade security, or use BiaVis to violate law or another person’s rights.

Fair competition

Submit only your own genuine activity. Do not fabricate sensor evidence, use vehicles for conventional-bike credit, manipulate location or camera input, interfere with scoring, exploit bugs, harass opponents, or evade enforcement. Server-verified facts control rankings and BiaVis Points. Verification can classify an activity as practice-only, review, rejected, or invalidated. BTech may correct obvious processing errors, investigate evidence, and reverse results obtained through abuse.

Community content and safety

You retain ownership of content you submit and grant BTech a worldwide, nonexclusive, royalty-free license to host, reproduce, display, modify only for formatting or safety, and process that content to operate, secure, moderate, and improve BiaVis. You represent that you have the rights needed to submit it. Do not submit unlawful, infringing, private, threatening, hateful, sexually exploitative, fraudulent, spam, or dangerous content.

BTech may filter, review, limit, remove, preserve, or report content and may suspend users under the Community Guidelines. Moderation is not guaranteed to catch every violation. Use in-app report and block controls when needed; call local emergency services for an immediate threat.

BiaVis Pro and Apple purchases

The current public version does not require a subscription. If BiaVis later offers BiaVis Pro, the app will display the price and billing period before purchase. Payment is charged to your Apple ID. Auto-renewable subscriptions renew unless cancelled at least 24 hours before the end of the current period, and Apple may charge within 24 hours before renewal. Manage or cancel in your Apple account settings. Restore Purchases checks the Apple ID currently signed into the App Store. Except where law or Apple’s rules require otherwise, Apple administers billing and refunds. Pro benefits, prices, and availability may change prospectively; a paid billing period will receive the access described at purchase or an appropriate remedy.

Availability and changes

BiaVis is provided without a promise that every feature, event, score, route, connection, or third-party integration will always be available or error-free. Features may change, be suspended, or be retired. We will not reinterpret an immutable historical scoring contract merely to change a future rule. If a material service change affects a paid feature, applicable law and Apple’s subscription rules continue to apply.

Termination and deletion

You may stop using BiaVis, sign out, or delete your account. Deletion removes or pseudonymizes data as described in the Privacy Policy and Account Deletion page. BTech may suspend or terminate access for safety, fraud, abuse, legal compliance, or material breach, with notice and appeal where required. Provisions that by their nature should survive—including ownership, verified historical facts, disclaimers, liability limits, and dispute terms—survive termination.

Disclaimers

To the maximum extent allowed by law, BiaVis is provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement. BTech does not warrant that BiaVis will be uninterrupted, secure, accurate, or suitable for a particular workout or route. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

Limitation of liability

To the maximum extent allowed by law, BTech and its members, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or opportunities arising from BiaVis. BTech’s total liability for claims relating to BiaVis will not exceed the greater of US $100 or the amount you paid BTech through the App Store for BiaVis during the 12 months before the event giving rise to the claim. These limits do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other categories protected by applicable law.

Disputes and governing law

Before filing a claim, email support@biavis.app with a description and requested resolution so both sides can try in good faith to resolve it for 30 days. This does not prevent urgent injunctive relief or a filing needed to preserve a legal deadline. New Mexico law governs these Terms without regard to conflict-of-law rules, and disputes may be brought in state or federal courts located in New Mexico, except that you may use an eligible small-claims court and mandatory consumer protections or venue rights in your location remain unaffected. These Terms do not require private arbitration or waive a right to participate in a class action.

Apple App Store terms

You and BTech acknowledge that these Terms are between you and BTech, not Apple. BTech, not Apple, is responsible for BiaVis, its content, maintenance, support, and claims relating to it. Apple has no obligation to provide maintenance or support. If BiaVis fails an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. BTech is responsible for addressing product-liability, legal-compliance, consumer-protection, and intellectual-property claims concerning BiaVis.

You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism and are not on a United States government prohibited or restricted-party list. You must comply with applicable third-party terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related provisions after your acceptance.

Changes and contact

If we materially change these Terms, BiaVis will ask you to accept the new version before continued use of affected cloud, competition, or community features. Contact support@biavis.app for ordinary support, privacy@biavis.app for privacy requests, safety@biavis.app for safety concerns that are not emergencies, and local emergency services for an immediate threat.
